WHY THIS PROJECT IS NECESSARY

This campaign is necessary because Halma’s growth strategy through discrete and cumulative acquisitions in sensitive health and safety markets may have generated risks that exceed the purely commercial sphere, reaching a magnitude that would justify regulatory intervention. We have alerted various authorities in Spain, including the National Commission for Markets and Competition (CNMC) and the Ministries of Health, Economy, Consumer Affairs, and Industry, about the need to investigate whether Halma’s practices infringe competition law or if its cumulative concentrations restrict effective competition. The aim of this campaign is to unite affected parties to assess the extent of the potential damage and demand accountability, as most victims often lack awareness of their rights or the means to act individually

POTENTIAL HARM

Potential causes of action being investigated include, among others, abuse of a possible dominant position by Halma in relevant markets, as prohibited by Article 102 of the Treaty on the Functioning of the European Union and national competition laws such as Spain’s Competition Defence Law (Ley de Defensa de la Competencia). The ensuing damages could be excessive prices, the imposition of unfair commercial terms, or practices that exclude competitors. Furthermore, product liability is being considered if reduced competitive pressure has negatively affected the quality or safety of products marketed by the Halma group, causing harm to users. This could translate into direct economic losses for customers due to overcharges, losses for competitors due to market exclusion, or physical and material damages for consumers in case of failures of essential safety products
